Once again we witness the absurdity within our judicial system that would allow an illegal alien who has committed murder to claim “his rights” under our constitution have been violated.

Yet that’s exactly what the accused murderer of Mollie Tibbetts is asserting.

Rivera, 25, was allowed to work for Yarrabee Farms with an illegal fake or stolen photo ID card while also providing a fraudulent Social Security card — in which no background check was done by the dairy farm regarding his legal status to work within the United States.

Investigators have concluded that Bahena-Rivera has been living illegally in the U.S. for four to seven years.

In July of 2018, Mollie Tibbetts went missing during a run on a deserted roadway. After a nationwide search, Tibbetts’ body was found in a cornfield in Poweshiek County, Iowa.

After an extensive investigation, Bahena Rivera was charged with Tibbetts’ murder after police said he admitted to confronting and chasing down the young woman.

However, a 29-page motion submitted by Rivera’s defense team claims that his constitutional rights were violated when local Iowa police took him in for questioning and did not make clear that he could have contacted the Mexican consulate before speaking to law enforcement.

Defense attorneys, Chad and Jennifer Frese, wrote within their motion,  “Providing this information to Bahena — a confused, exhausted and vulnerable Mexican national was seeking trustworthy help — would have triggered an invocation of consular notification and a decision to await the consulate’s assistance before making any other statements.”

The defense duo also claims police did not read Bahena Rivera his Miranda Rights until hours into his 12-hour interrogation.

The attorneys are calling for his murder confession to be nullified, claiming also that he has “very limited Mexican education” and “wholly unfamiliar with the U.S. criminal justice system.”

Bahena Rivera’s trial is set to begin on November 12th; however, his attorneys are seeking his murder confession to be thrown out before the trial date begins.

His attorneys have already successfully got his trial date pushed back and relocated to another area within the district that has a higher population of Hispanics.

According to prosecutors, Bahena Rivera was the last person who saw Tibbetts jogging on the evening of July 18th in Brooklyn, Iowa, security camera footage reveals.

In his initial confession, Bahena Rivera acknowledges that he saw Tibbetts jogging, and that’s when he began to approach her and started a conversation. However, Tibbetts sensing that something wasn’t right warned the illegal alien to leave her alone or she would call the police if he didn’t stop following her.

Bahena Rivera began chasing her and that’s when he claims he suddenly and conveniently “blacked out.”

While Bahena Rivera hasn’t actually confessed to murdering Tibbetts the fact that he took police to the murder scene is proof enough even without his confession.

Police have pieced together what they believe took place after Tibbetts rebuked the illegal alien. In a fit of rage, he stabbed the young college student to death; he then drove to a cornfield where prosecutors say he placed corn stalks over her to hide her body. The illegal alien has been held on a $5 million bond.

If proved accurate that police didn’t do their due diligence then they should be held accountable.

However, the wider issue that must be addressed is whether illegal aliens have the exact same constitutional rights as American citizens, and if so why?

    I am appalled that these defense lawyers would even consider a constitutional defense that he has the same rights as a U.S. citizen. He broke the law when he crossed the border to come here, and then kills a young college girl. Despicable.

    Liberals will demand his release because he was “only trying to get a better life”. In the democratic view only a racist would question his right to enter this country without any screening OR criticize what he does when he gets here.

    this again proves we need the Wall and 100% background checks on anyone entering the country. I am all for him having a long talk with “Judge Rope” his photo taken after that talk.
    Legally he has absolutely no rights to be here nor any “rights” to use our courts to wiggle his way out of trouble.

    Why would they offer him a call to the Mexican Consulate If he showed “…an illegal fake or stolen photo ID card..” which surely wasn’t a Mexican ID.
