Judge Blocks Cuomo’s attempt for Trump’s tax returns

A federal judge has just put the brakes (temporally) on New York Gov. Andrew Cuomo’s bill that would’ve allowed certain members of Congress to access the President’s New York state tax returns.

Politico reported on Thursday, the order from Judge Carl Nichols in blocking any attempt by New York State, is predicated on New York State’s assertion that Judge Nichols lacks jurisdiction over the issue, because he resides in Washington

The Judges order thus far blocks any House Ways and Means Committee requests for the President’s tax returns via the New York law until the jurisdictional dispute is resolved.

The President’s attorneys filed a lawsuit on July 23rd  arguing New York State violated the President’s constitutional rights when it passed the law earlier in July that would give the majority Democrat House Ways and Means Committee access to the President’s state tax returns,

Nichols a Trump appointee said during a D.C. court hearing on Wednesday that “Mr. Trump cannot suffer any harm” until the issue is resolved, the Washington Examiner reported.

“I continue to expect that while I have this under advisement actions won’t be taken to moot this,” the judge continued.

New York attorney Andrew Amer told Judge Nichols on Wednesday that his clients believe the D.C. court does not have authority over the case and he would try to move it elsewhere or have it dismissed entirely.

The bill, which is obviously politically motivated and created “exclusively” for President Trump was easily passed by the Democratically controlled state Legislator in Albany last month, for the sole purpose of harassing the President by continuing the unbridled witch hunt that began the moment Donald Trump was declared the winner in the wee hours of November 9th, 2016.

This latest attempt by the self-aggrandized governor along with Democratic lawmakers within New York State to actually devise and create a law for one individual, simply illustrates just how desperate Democrats have become that they’re willing to use their elected office in such a sordid way.

At the time the bill was signed Cuomo attempted to legitimize his politically motivated actions by stating “This bill gives Congress the ability to fulfill its Constitutional responsibilities, strengthen our democratic system and ensure that no one is above the law,” Cuomo, a Democrat, said in a statement. “Tax secrecy is paramount — the exception being for bona fide investigative and law enforcement purposes.”

However, the President’s lead attorney Jay Sekulow called the bill exactly what it was, “more presidential harassment.”

Another hearing is scheduled to take place on August 29th in Washington to decide whether Judge Carl Nichols has jurisdiction over the New York officials named as defendants in the president’s lawsuit.

New York has singled to Judge Nichols it would hold off on responding to any such legal request for seven days until after the jurisdiction matter is settled.

Democratic California Gov. Gavin Newsom has also signed a bill similar to Cuomo’s on July 30th that would also attempt to get the President’s tax returns for at least five years in order to qualify for California’s primary ballot in 2020.

The Trump campaign responded critically to California’s the new law.

“There are very good reasons why the very liberal Gov. Jerry Brown vetoed this bill two years ago – it’s unconstitutional and it opens up the possibility for states to load up more requirements on candidates in future elections,” Tim Murtaugh, Director of Communications for Trump’s 2020 re-election campaign, told the Daily Caller News Foundation. “What’s next, five years of health records?”

Opponents of the legislation criticized the actions of both Cuomo and Newsom calling it “political,” with one Republican assemblyman, Doug Smith, saying the legislation was being “used as a weapon against Trump.”

I agree with the judge that the President doesn’t have to turn over squat to the bums.
