Avenatti Blows It

Avenatti Blows It

Michael Avenatti, prospective presidential candidate and lawyer for Stormy Daniels – also known as “the mouth that whored” — may have done himself in with his stunt to grab a bit of the spotlight focused on the confirmation hearings for Judge Brett Kavanaugh.  First, he teased the gullible media that he had a client who he said could confirm Kavanaugh’s excessive drinking and sexual assaults on women.

He then produced Julie Swetnick, who offered up the most damaging and salacious claim that Kavanaugh was one of a group of young men who would ply young girls with alcohol or “something” put into the punch bowl — and then the vulnerable girls would be gang raped.

Her story folded like a tent in a hurricane. Not only did her “facts” keep changing, but there was no corroboration.  Nothing.  It was so concocted that only the most strident Kavanaugh opponents would  embrace the accusations for purely shameful political purposes.   There was even the strange situation of an anti-Kavanaugh media panelist excoriating Avenatti and Swetnick for advancing such obviously phony charges followed by an intermission in which the station hyped it as an exclusive interview with none other than Swetnick.

Avenatti’s Svengali role may have gotten him some short term publicity but may now result in the criminal prosecution of his client for making false claims.   Will Swetnick flip on Avanatti and expose the entire thing as a sham?  One can only hope.

It will be interesting to see how the media deals with this charlatan.  Prior to this episode, Avenatti was the darling of the #NeverTrump press.  His activities were reported thousands of times, with hundreds of on-air interviews.  But now that he is damaged goods, will they still prop him up?

We may have gotten a hint from Chuck Todd, who has dual roles on NBC and MSNBC, as host of Meet the Press and MTP Daily respectively. Todd, who is one of the leading left leaning media personalities, opined that, “Michael Avenatti is probably the best thing to happen to Brett Kavanaugh. All these Democrats that have been flirting with him, they’ve got to really be embarrassed by him now.”  Of course, he failed to include the press in that.

Avenatti also blew a hole in the #MeToo Movement by offering up evidence that false accusations do exist – and that political motivation can be the root of some of them.  In puffing himself up, Avenatti further undermined the credibility of accuser number one, Christine Blasey Ford.

Maine Senator Susan Collins did not overlook the opportunity that Avenatti gave Republicans.  In her full-throated support of Kavanaugh, Collins noted that:

“… the allegation that when he was a teenager, Judge Kavanaugh drugged multiple girls and used this weakened state to participate in gang rape. This outlandish allegation was put forward without any supporting evidence and simply parroted in the public statements of others.  That such an allegation can find its way into the Supreme Court confirmation process is a stark reminder about why the presumption of innocence is so ingrained in our American consciousness.”

This stunt also cast a dark shadow over the motivations and the facts that led to the Daniels accusations.  Was Avenatti truly representing the porn personality or was he just using her like one of the men on the movie set, for his own pleasure – in his case to sleaze into the national spotlight?  You can answer that one for yourself.

In a previous commentary, I had compared Avenatti to the sleazy  lawyer, Billy Flynn, played by Richard Gere in the musical ”Chicago.”  The comparison is even more apt today.  In one scene, Flynn has his client on his lap as a ventriloquist dummy during a press conference – answering all the questions in her stead.  That is exactly how we should view Avenatti and Swetnick.

It is time that the American Bar Association bars attorneys representing clients to take advantage of the client’s claims for personal gains, such as launching a political career. It is not that a lawyer do no advocate for his or her clients claim in public. It is that in doing so must be made clear that all is about the client.
